Elizabeth Rust, the Sudbury Department of Planning and Development employee who was cited for her third OUI the morning of May 9, will next be in court on Nov. 9 for a compliance and election hearing, according to documents obtained at Framingham District Court.

On Nov. 9, the court will determine whether the Sudbury Police Department has complied with its discovery of the case. Attorneys will then discuss a possible trial date. Rust's lawyer, Seamus L. O'Kelly, could also plead out at that time.

Until then, Rust's driving restrictions have been extended.

Rust lost her right to drive at her arraignment on June 19, except for working purposes. She can drive Monday through Friday, between 7 a.m. and 5 p.m. She cannot drive during the weekends.

Rust pleaded not guilty to the charge and has been subjected to random alcohol tests. Judge Robert Harbour stated she must also attend two Alcoholics Anonymous meetings a week and cannot drink any alcohol.

Rust crashed her car during the early morning hours of May 9 on Concord Road when she hit two signs and a granite post at the Union Avenue intersection.

According to the police report obtained at the clerk’s office, Rust told Officer Erin Corey she had recently left Lavender Asian Cuisine & Bar after Town Meeting ended the night of May 8. Rust repeatedly told Corey she worked for the town.

Corey asked Rust if she would take road sobriety tests, and originally agreed. But Rust started to complain of dizziness and was transported to Emerson Hospital.

Corey noted in her report there was a strong odor of alcohol emanating from Rust, that her speech was slurred and her eyes were bloodshot.

At one point, Corey also noted Rust said she couldn't see her despite standing 2 feet away.

Sudbury police opted to cite Rust rather than arrest her that night due to staffing.

The Sudbury Fire Department was also ordered to release all records regarding the crash from May 9.
