Motion to Suppress Evidence to be Made in Elizabeth Rust OUI Case
The Sudbury Department of Planning and Development employee will next be in court on March 11.
Framingham District Court Judge Robert Greco issued a continuance in the Elizabeth Rust OUI case after her attorney, Seamus L. O'Kelly, asked for a motion to suppress evidence Monday morning.
Greco will hear the argument to suppress evidence on March 11.
Greco was also told full discovery of evidence was not complete.
Rust lost her right to drive at her arraignment on June 19, except for working purposes. She can drive Monday through Friday, between 7 a.m. and 5 p.m. She cannot drive during the weekends.
Rust pleaded not guilty to the charge and has been subjected to random alcohol tests. Judge Robert Harbour stated she must also attend two Alcoholics Anonymous meetings a week and cannot drink any alcohol.

hmmm...Rust plows over curb knocks down granite marker and 2 signs - total damage according to Town (cleaned up by 8am next day) was less than a couple of hundred dollars
FOI request to find out damage and get list of DPW workers involved $300??????
The fix is in....

I wonder if Good Ol' Beth's SSI card is part of the evidence seeing that she handed it to the coppers when they asked for her license.
This whole thing remains a complete embarrassment for the town of Sudbury and will not go away until she is convicted. It's not like this was her first or even second offense. How ridiculous is this whole incident? Please send this dangerous woman to jail and take away her license. Otherwise she may never learn and will just do it again.

The DA has the obligation to turn over all exculpatory evidence, and they haven't done so, obviously. Ms. Rust has every right to fight the case as any of you would if you were facing mandatory 5 months jail time. (Mind you her prior offenses were over 20 years ago). Let the jury or judge decide ultimate guilt. She has a constitutional right to her day in court.
I know for a fact that she has been very diligent in her recovery/AA efforts and staying sober. She should be applauded for her courage in getting help, not continually denigrated. Most alcoholics have to hit rock bottom to get help. I doubt any of you have ever been subject to this amount of public scrutiny and humiliation.
Beth is a wife and mother to two teenage children. Do you not think she's suffering because of this and the possibility of going to prison? C'mon people, try to see both sides of the coin. If she's convicted and sentenced to prison, then she will have to do the time and face the punishment, and all of you should shut the hell up and get a life.

She won't. I would bet my life on it and that of my children. That is how hard she is working her program. Even if she's acquitted the judge could put a IID in her car to prevent her from ever driving drunk again. Simple solution.
There's also the risk that you will kill a member of my family driving under the influence. How many times have you driven after having a few drinks? Doesn't take much to get to 0.08 BAC

The only thing I see " that is how hard she is working " is trying to beat the charges. If you know her so well then you would admit she has a drinking problem because you said she is working hard on it, then why doesn't she just plead guilty and get on with her life than try to weasle out.

You don't need to go to prison for 5 months and lose your job in order to recover...that doesn't help the situation. Treatment, not prison time, is the answer. You obviously have no experience with people suffering from addiction...

Ever read about the driver who has a 6th or 8th DUI and finally kills someone. I bet he attended AA meetings and got treatment also. Your friend is on her way, this is her 3rd DUI. The treatment she got after the 1st and 2nd didn't go to well. Why should the 3rd ?
