Planning Board Proposes Articles for 2013 Annual Town Meeting

Public hearing scheduled for April 10.

 

In accordance with the provisions of M.G.L. Chapter 40A, Section 5, the Sudbury Planning Board will hold a public hearing on Wednesday, April 10, 2013 at 7:30 p.m. at the Town Hall, 322 Concord Road, Sudbury, Massachusetts concerning the following  articles on the Warrant for the May 6, 2013 Annual Town Meeting.   1. Amend Zoning Bylaw, Article IX, Sections 5336(d) and 5435(c) – Senior Residential Community and Incentive Senior Development Bylaws (Submitted by the Council on Aging)

Amend sections 5336(d) and 5435(c) to increase the number of allowable one-bedroom units in the Senior Residential Community and Incentive Senior Development Bylaws from 10% to 25%.

  1. Amend Zoning Bylaw, Article IX, Section 6330 - Site Plan procedures

Amend Section 6330, Site Plan Procedures, to replace the word “unanimous” with the word “majority”, so that sentence reads as follows, “A unanimous majority vote of the Board of Selectmen shall be required and shall be in writing.” 

  1. Amend Zoning Bylaw, Article IX, Section 6300, et. al – Replace Board of Selectmen Site Plan Authority with Planning Board

Amend Section 6300 in its entirety and Sections 2210, 3113, 3113(f), 3144, 3320, 3427(d), 3431, 3533, 3544, 3570 and 3590 to substitute the words “Planning Board” for “Board of Selectmen”, wherever they appear in those sections, and to substitute the words “Board of Selectmen” for “Planning Board” in section 6360, and to amend Section 2230, Appendix A, Use C.4 (Animal clinic or hospital) by replacing “BOS” with “ZBA” as the special permit granting authority for those uses in Business Districts. 

  1. Amend Zoning Bylaw, Article IX, Section 2326 -  Accessory Structures

Amend Section 2326 to replace the words “12 feet in length on any side, or with a maximum gross floor area of one hundred twenty square feet, whichever is less” with the words “16 feet in length on any side”. 

  1. Amend Zoning Bylaw, Article IX, Section 4500 (Wastewater Facilities Bylaw) to delete this bylaw in its entirety

   6.   Amend Zoning Bylaw, Article IX, to add a new Section 8000 - Temporary Moratorium on Medical Marijuana Treatment Centers

Amend the Town’s Zoning Bylaw by adding a new Section 8000, TEMPORARY MORATORIUM ON MEDICAL MARIJUANA TREATMENT CENTERS, that would temporarily prohibit such uses in the Town of Sudbury until June 30, 2014, giving the Town time to study the as-of-yet published Department of Public Health regulations on these facilities and promulgate local regulations for permitting them in Sudbury.

Wow! Talk about a Power Play. Mark Kablack, husband of our Town Planner Jody Kablack, has had trouble recently ramming his requested site plan modifications on behalf of his developer and condo clients through the town approval process. One selectman did not go along with rubber-stamping the changes Kablack requested for Northwood. Solution? Just look at these proposed bylaw changes regarding Section 6300. First try to remove the unanimous vote provision, so that the majority "Friends of Kablack" group can have their unencumbered way. Better yet, take the approval authority away from the BOS altogether and give it to the Planning Board, which is under the control of Jody Kablack's Planning Department. Remember the recent BOS meeting, when selectman Haarde was questioning Town Planner Jody Kablack? She decided she did not like the questioning, and stormed out of the meeting. These proposed changes to Section 6300 are Sudbury Power Politics at its best.

Sid you're dead on my friend. Jody is trying to take control of these decisions before we go from 3-5 Selectman and there becomes a potential for John and Larry to become outnumbered and not be able to help push Jody's agenda anymore. We need to stop this from happening at Town Meeting. Sid I hope you lead the charge and I guarantee many will be there to support you.

Does anyone know the substance of the four articles that Ralph Tyler tried to bring forward by petition? Were they related to any of this? All we heard were the reasons that Tyler did not follow proper protocol in filling out the forms (according to Town Council).

How low can Sudbury go? This is incredible! The people of Sudbury would have to be out of their minds to vote for these articles. Is there no end to the Sudbury insider politics? It should be a rancourous Town Meeting.

I would have to agree here. Removing the oversight authority from the BOS is NOT in the best interests of the town. I respectfully ask you to vote NO on this: Amend Zoning Bylaw, Article IX, Section 6300, et. al – Replace Board of Selectmen Site Plan Authority with Planning Board
AND NO on this: Amend Zoning Bylaw, Article IX, Section 6330 - Site Plan procedures

I would also like to hear arguments on this before casting my vote: Amend Zoning Bylaw, Article IX, Section 4500 (Wastewater Facilities Bylaw) to delete this bylaw in its entirety

I just bought a new dictionary and when I looked up the definition of "conflict of interest" the Kablack's picture was there.

Any truth to the rumor that at 2014 Town Meeting there will be an article to put Beth Rust in charge of all driver's ed classes in Sudbury?
