Framingham District Court Judge Robert Greco issued a continuance in the Elizabeth Rust OUI case after her attorney, Seamus L. O'Kelly, asked for a motion to suppress evidence Monday morning. Greco will hear the argument to suppress evidence on March 11. Greco was also told full discovery of evidence was not complete. Rust was last in court on Dec. 21 for a compliance and election hearing, but the case was continued. The clerk's office did not have any information on whether her driving restrictions were extended. Elizabeth Rust, the Sudbury Department of Planning and Development employee who was cited for her third OUI the morning of May 9, will next be in court on Dec. 21 for a compliance and election hearing after a judge agreed to continue the case on Nov. 9, according to documents obtained at Framingham District Court. On Dec. 21, the court will determine whether the Sudbury Police Department has complied with its discovery of the case. Attorneys will then discuss a possible trial date. Rust's lawyer, Seamus L. Clerk's office confirms incident from early morning hours of May 9.
Elizabeth Rust of the Sudbury Department of Planning and Community Development department will be arraigned on June 27 to face an OUI charge from the night of May 9, according to the Framingham District Court Clerk's office. Sudbury Patch received the information just after 12:30 p.m. on Monday. A message left for Rust in her office seeking comment was not immediately returned. A person who answered the phone said she was out for the day. The Sudbury Police Department cited Rust for an OUI, her third, after allegedly driving over the island near Concord Road, striking two signs and colliding with a granite post the morning of May 9. No special treatment at all. If you take the breathalyzer and fail it's a 30 day suspension prior to trial. If, like this case, the police do not administer a breathalyzer because the driver went to the hospital, there is no suspension by the RMV. So she received no special treatment.
