Judge Conflicted About Odgren's Sentence, But Refuses to Reduce It

Lawyer hopes to challenge ruling based on consitutional grounds.

Middlesex Superior Court Judge S. Jane Haggerty cited legal limitations yesterday when she refused to alter the life sentence of John Odgren, who was convicted of killing a fellow classmate, James Alenson, three years ago. In a 12-page decision, Haggerty brought up concerns with the idea of a juvenile being sent to prison for life without the eligibility of parole, even for murder. It's an issue that has been on the radar screen of youth advocates in recent years. Odgren's Lawyer, Jonathan Shapiro, said there is hope for a challenge to the sentence based on constitutional grounds. Patch.com left a message at Shapiro's office seeking more comment.

Judge Denies Odgren in Bid for Lower Sentence

Former Lincoln-Sudbury student was convicted of first-degree murder in April in the slaying of James Alenson.

Middlesex Superior Court Judge S. Jane Haggerty rejected a request to reduce the conviction of John Odgren, a teenager who was found guilty of first-degree murder in the fatal stabbing of another boy at Lincoln-Sudbury Regional High School. Lawyers for Odgren asked that his conviction from April be reduced to second-degree murder. That sentence would make him eligible for parole after 15 years. A first-degree murder conviction does not allow the possibility of parole. Odgren is serving a mandatory life sentence in the 2007 killing of 15-year-old James Alenson. Lawyers argue Odgren, who was 16 at the time of the murder,  was mentally ill when he attacked Alenson.
