Jury Will Get Rust OUI Case

Next court date is June 26.

Elizabeth Rust's fate will be in the hands of a jury. Rust, a Sudbury Department of Planning and Development employee who was cited for her third OUI the morning of May 9, 2012, after leaving an after-hours party at Lavender Asian Cuisine & Bar, will next be in court on June 26 after her lawyer, Seamus L. O'Kelly, withdrew a motion to suppress evidence Monday morning. Rust, who was seen in court Monday, lost her right to drive at her arraignment on June 19, except for working purposes. She can drive Monday through Friday, between 7 a.m. and 5 p.m. She cannot drive during the weekends. Rust pleaded not guilty to the charge and has been subjected to random alcohol tests. No special treatment at all. If you take the breathalyzer and fail it's a 30 day suspension prior to trial. If, like this case, the police do not administer a breathalyzer because the driver went to the hospital, there is no suspension by the RMV. So she received no special treatment. Motion to Suppress Evidence to be Made in Elizabeth Rust OUI Case

The Sudbury Department of Planning and Development employee will next be in court on March 11.

Framingham District Court Judge Robert Greco issued a continuance in the Elizabeth Rust OUI case after her attorney, Seamus L. O'Kelly, asked for a motion to suppress evidence Monday morning. Greco will hear the argument to suppress evidence on March 11. Greco was also told full discovery of evidence was not complete. Rust, a Sudbury Department of Planning and Development employee, was cited for her third OUI the morning of May 9, 2012, after leaving an after-hours party at Lavender Asian Cuisine & Bar. Acton Man Faces 2 OUI Charges in Sudbury

The following arrest information was supplied by the Sudbury Police Department. It does not indicate a conviction.

Several 911 calls to the Sudbury Police Department on Wednesday regarding an erratic driver resulted in the arrest of an Acton man. According to Lt. Robert Grady, the responding officer pulled over Brian Gargone, 24, of 280 Arlington St., Apt. 1L, on Hampshire Street at about 5:10 p.m. After an investigation was completed, Garone was arrested and charged with: Grady said there was evidence of both alcohol and marijuana in the car. Gargone was released at 9:30 p.m. and was scheduled to be arraigned at Framingham District Court on Thursday.

Next court date will be for a discovery and election hearing.

Elizabeth Rust, the Sudbury Department of Planning and Development employee who was cited for her third OUI the morning of May 9, will next be in court on Feb. 4 for a discovery and election hearing, according to the Framingham District Court clerk's office. Rust was last in court on Dec. 21 for a compliance and election hearing, but the case was continued. The clerk's office did not have any information on whether her driving restrictions were extended. Rust lost her right to drive at her arraignment on June 19, except for working purposes. She can drive Monday through Friday, between 7 a.m. and 5 p.m. She cannot drive during the weekends. The Sudbury town employee who is facing a third OUI charge will next appear before a judge on Sept. 21

Elizabeth Rust, the Sudbury Department of Planning and Development employee who was cited for her third OUI the morning of May 9, today had her pretrial conference delayed until Sept. 21, the Framingham District Court clerk's office said. According to Sudbury Police Lt. Scott Nix, her lawyer, Seamus L. O'Kelly, has requested discovery from the department. Nix said they are complying. Rust lost her right to drive at her arraignment on June 19, except for working purposes. She can drive Monday through Friday, between 7 a.m. and 5 p.m. She cannot drive during the weekends. Rust Loses Some Driving Privileges During OUI Arraignment

Defense counsel brought Elizabeth Rust in ahead of the original scheduled June 27 arraignment.

Elizabeth Rust, the Sudbury Department of Planning and Development employee who was cited for her third OUI the morning of May 9, was in Framingham District Court Tuesday morning for her arraignment, eight days ahead of her original arraignment date. Her lawyer, Seamus L. O'Kelly, brought the case forward today. According to documents obtained from the clerks office, Rust lost her right to drive other than for working purposes. She can drive Monday through Friday, between 7 a.m. and 5 p.m. She cannot drive during the weekends. Rust pleaded not guilty to the charge and will be subjected to random alcohol tests. Haarde: Don't Point Fingers at Sudbury PD Regarding Lavender

The Board of Selectmen vice chair recently sat down Police Chief Richard Glavin and came away convinced the department did everything right.

During last week's Board of Selectmen meeting, Vice Chair Bob Haarde fumed that the chief of police wasn't invited to be part of the Lavender licensing violation discussion. He called on Town Manager Maureen Valente to ask Richard Glavin to take part in a meeting he wanted schedule for this week. Instead, Haarde met with Glavin on Friday to ask questions related to the Lavender incident from May 8-9 and left convinced the officers who worked that night did everything by the book. "The Chief gave all details, and I've been confident all along they did the right thing," Haarde said. LETTER TO THE EDITOR: Issue is Accountability, Not Vendetta

Sudbury resident Michael Troiano says the town deserves answers to the questions surrounding the Lavender incident.

After reading what happened at Lavender and at Union Avenue on the night of May 9, a group of concerned friends and I attended the last Board of Selectmen meeting. Chairman O’Brien scheduled the issue last in the evening, and after a lengthy discussion of the NStar debacle, we finally got to it around 11:30. Mr. O’Brien read a prepared statement acknowledging poor judgment but no legal breach on his part, and left the room. Selectman Drobinsky did not recuse himself, and instead refused to second Selectman Haarde’s repeated requests to dig deeper into the issue of what happened that night.
