Framingham District Court Judge Robert Greco issued a continuance in the Elizabeth Rust OUI case after her attorney, Seamus L. O'Kelly, asked for a motion to suppress evidence Monday morning. Greco will hear the argument to suppress evidence on March 11. Greco was also told full discovery of evidence was not complete. Several 911 calls to the Sudbury Police Department on Wednesday regarding an erratic driver resulted in the arrest of an Acton man. According to Lt. Robert Grady, the responding officer pulled over Brian Gargone, 24, of 280 Arlington St., Apt. 1L, on Hampshire Street at about 5:10 p.m. After an investigation was completed, Garone was arrested and charged with: Grady said there was evidence of both alcohol and marijuana in the car. Gargone was released at 9:30 p.m. and was scheduled to be arraigned at Framingham District Court on Thursday.

The Board of Selectmen vice chair recently sat down Police Chief Richard Glavin and came away convinced the department did everything right.
During last week's Board of Selectmen meeting, Vice Chair Bob Haarde fumed that the chief of police wasn't invited to be part of the Lavender licensing violation discussion. He called on Town Manager Maureen Valente to ask Richard Glavin to take part in a meeting he wanted schedule for this week. Instead, Haarde met with Glavin on Friday to ask questions related to the Lavender incident from May 8-9 and left convinced the officers who worked that night did everything by the book. After reading what happened at Lavender and at Union Avenue on the night of May 9, a group of concerned friends and I attended the last Board of Selectmen meeting. Chairman O’Brien scheduled the issue last in the evening, and after a lengthy discussion of the NStar debacle, we finally got to it around 11:30. Mr. O’Brien read a prepared statement acknowledging poor judgment but no legal breach on his part, and left the room. Selectman Drobinsky did not recuse himself, and instead refused to second Selectman Haarde’s repeated requests to dig deeper into the issue of what happened that night. No special treatment at all. If you take the breathalyzer and fail it's a 30 day suspension prior to trial. If, like this case, the police do not administer a breathalyzer because the driver went to the hospital, there is no suspension by the RMV. So she received no special treatment.
